The Sales Terms and Conditions given here regulate the offer and sale of products on the website www.dalpassoshop.it by Dalpasso Srl.
These Sales Terms and Conditions specifically regulate:
For communications regarding orders or requests for assistance, customers may contact Dalpasso Srl by sending an e-mail to: dalpassoshop@otticadalpasso.it or by calling: 0522 453999, active from Monday to Friday, from 9:00 am to 1:30 pm and from 2:00 pm to 5:30 pm.
You must be over the age of eighteen to make a purchase. As regards anything not specifically provided for by the purchase terms and conditions below, any purchases made on Dalpasso Srl are regulated by Italian Legislative Decree No. 206, 6 September 2005, regarding consumer protection for remote agreements.
The supplier of the products on the website is the company Dalpasso Srl, via Turri, 10 – 42121 Reggio Emilia, VAT No. 01432940359 – Reggio Emilia Business Register No. 01432940359, Economic and Administrative Index (REA) No. RE-185303, Chamber of Commerce (C.C.I.A.A.).
Product specifications are provided in the on-line catalogue and can be viewed when you choose and complete the order form before completing the forwarding procedure. Prices are expressed in euros, inclusive of VAT and every other tax and duty, and are given by the side of each product in the on-line catalogue. Any delivery charges, where envisaged, will be clearly indicated before final confirmation of the order.
The price invoiced will be the one next to the product at the time the order is concluded, plus the delivery charge, where envisaged, without taking into account any subsequent updates.
Dalpasso Srl reserves the right to change product prices and delivery charges without prior warning.
Any new sums will take effect from the moment they are published on the Dalpasso Srl website and will be applied to sales made from then onwards, without affecting orders already confirmed.
Once the order has been completed, Dalpasso Srl will send an e-mail to confirm receipt of the order. The e-mail will contain a summary of the order and of the products purchased, the total price and any delivery charges. The consumer is invited to keep this communication; in the event he/she does not receive it, he/she is invited to notify Dalpasso Srl by sending an e-mail to dalpassoshop@otticadalpasso.it.
As soon as the parcel is dispatched, Dalpasso Srl will send a second e-mail containing the order summary and the shipment tracking details, where available.
If it is even temporarily impossible to partially or completely dispatch the order, Dalpasso Srl will promptly send an e-mail to agree with the consumer, without prejudice to the possibility of the consumer asking to cancel the order, even partially, and for the return of any corresponding sum already paid, according to the methods agreed with the consumer.
Should the user’s data prove to be incomplete or in any case inaccurate such as to make it impossible to deliver the parcel, Dalpasso Srl will contact the consumer to request confirmation of the shipping data or an alternative address in order to proceed with the shipment. If the consumer does not provide the necessary information within five days, Dalpasso Srl may suspend the processing of the order or proceed with its cancellation, reimbursing any sums already paid.
Dalpasso Srl also reserves the right to cancel an order if, due to contractual constraints, commercial agreements or limitations imposed by manufacturers or authorised distributors, the sale or shipment of certain products to specific countries or geographical areas is not permitted. In such cases, the customer will be promptly informed and, if payment has already been made, the full amount paid will be reimbursed.
Where possible, any limitations on sale or shipment will be made known before the order is concluded.
Payment
Dalpasso Srl offers a choice of various payment procedures when the order is finalised:

- Advance bank transfer, to be made after completing the order, indicating the following data:

Send a copy of the bank transfer order or bank receipt to amministrazione@dalpasso.it within three working days. When we receive the bank credit, we will proceed to process your order.
Your package will contain the accompanying invoice for your order, with details of the products purchased and the relevant prices, regardless of whether the purchase is made by a private individual or a company. If payment is not received within the indicated term, Dalpasso Srl may suspend the processing of the order or proceed with its cancellation.
The use of payment services managed by third parties, such as PayPal, Apple Pay, Google Pay, Klarna and Scalapay, is also subject to the terms, conditions and procedures provided by the respective service providers.
Any customs fees, duties and any other additional costs that may be requested by the customs or tax authorities are the sole responsibility of the buyer and do not depend on Dalpasso Srl.
VAT relief
Some aids intended for people with disabilities benefit from the application of 4% VAT relief.
When a product benefits from 4% VAT relief, this information is expressly indicated in the relevant product sheet or in the description of the item. In these cases, the price shown in the product sheet already includes 4% VAT relief.
The 4% VAT relief applies exclusively to products for which this rate is expressly indicated on the website. For all other products, the ordinary VAT rate provided for by current legislation will apply.

Delivery
Dalpasso Srl will deliver the products purchased by courier to the shipping address indicated by the customer at the time of the order and guarantees delivery throughout the country within 48 hours from the day of dispatch, except for delays not attributable to Dalpasso Srl or particular conditions linked to the destination.
As soon as the parcel is dispatched, Dalpasso Srl will send the customer an e-mail containing the order summary and the shipment tracking details.
If the courier is unable to deliver due to the addressee’s absence, it will follow the procedures provided by its own service.
These procedures may vary depending on the courier appointed and may include, by way of example: contact with the customer by telephone or e-mail; one or more further delivery attempts on the following days; or the deposit of the parcel at a branch, pick-up point or courier office, with the relevant notice to the customer so that he/she may collect it personally.
The customer is required to indicate correct, complete and up-to-date shipping data. In the event of failed delivery due to the addressee’s absence, incorrect or incomplete data, or failure to collect the parcel, any storage, redelivery or return costs may be charged to the customer.
If delivery is delayed, the consumer is invited to contact Dalpasso Srl and report any inefficiencies noted. Dalpasso Srl undertakes to provide assistance to the customer, checking the status of the shipment with the appointed courier and communicating the available information to the customer.
Withdrawal
Italian Legislative Decree No. 206 of 06/09/2005, Arts. 52 et seq., regarding consumer protection for agreements made remotely, envisages the possibility for the consumer to exercise the right of withdrawal without having to provide any explanation, within 14 calendar days from the date of receipt of the goods indicated by the carrier.
To exercise the right of withdrawal, the consumer must send Dalpasso Srl an explicit communication of his/her wish to withdraw from the contract, by e-mail to dalpassoshop@otticadalpasso.it, indicating the following data:
- Order number
- In the event of partial withdrawal, a description and quantity of the products you intend to return
- Indication of the payment method used for the purchase
- Bank details to receive the reimbursement bank transfer, IBAN CODE, where necessary
If the name of the account holder differs from the name on the invoice, this must be indicated.
In the event of payment by credit card or another electronic payment method, the sum will be reaccredited using the same payment method used by the customer for the purchase, where possible.
The right of withdrawal cannot be exercised for customised, made-to-measure or sealed products that cannot be returned after opening.
In particular, the following cannot be returned:
- opened packs of contact lenses, contact lens liquids, artificial tears or products for ocular prostheses
- products customised, modified or specially ordered for the customer
- glasses modified after delivery
- products that are damaged, incomplete, used beyond normal testing or tampered with
Frames may be tried on as would happen in store, but they must be returned undamaged, complete and in the same condition in which they were delivered. The fitting of lenses, technical adjustments, modifications or interventions carried out by the customer or by third parties make the product no longer compliant with its original condition and may result in refusal of the return or a reduction of the refund.
The consumer shall be responsible for returning the goods, shipping them within 14 calendar days from the date on which he/she communicated to Dalpasso Srl his/her wish to withdraw, to the location specified by Dalpasso S.r.l. in its reply to the e-mail containing the return request. Return procedures are given in the “Orders and returns” section of the website.
The consumer must return the products purchased undamaged, complete with all their parts, accessories and documentation, preferably in the original packaging and in any case adequately packed in order to avoid damage during transport.
In the event of withdrawal, delivery costs are the sole responsibility of the buyer, including any customs fees, duties and any other additional costs that may be requested by the customs or tax authorities.
The refund will be made only after the product has returned to the Dalpasso Srl premises and after its integrity has been checked. Dalpasso Srl will reimburse the consumer the value of the returned goods, withholding the delivery charges indicated in the order summary.

Guarantee
In the event of a defective or non-compliant product, the consumer may avail himself/herself of the legal guarantee of conformity provided for by Italian Legislative Decree No. 206, 6 September 2005.
For consumers, the products purchased are covered by the legal guarantee of conformity, lasting two years from delivery of the goods, according to the terms and conditions provided for by current legislation.
Should the consumer find a defect in one or more products purchased, he/she is invited to promptly inform Dalpasso Srl by sending an e-mail to dalpassoshop@otticadalpasso.it or by sending a PEC to dalpassosrl@legalmail.it.
In the event of an ascertained conformity defect, the consumer has the right to have the conformity of the product restored by means of free repair or replacement, according to the provisions of current legislation.
If the purchased item is no longer available, Dalpasso may propose to the purchaser an alternative product of similar value, without prejudice to the consumer’s right to accept this proposal or to avail himself/herself of the other remedies, such as a price reduction or refund.
Any guarantee offered by the manufacturer is additional to the legal guarantee of conformity and does not replace or limit it.
If the package contains a manufacturer’s guarantee certificate, this must be kept and shown together with the purchase invoice issued by Dalpasso Srl in order to request assistance under guarantee. Dalpasso Srl remains available to provide any information in this regard.

Privacy
Dalpasso Srl wishes to inform you that the data provided by the consumer will be processed in compliance with EU Regulation 2016/679, “GDPR”, and Italian Legislative Decree No. 196 of 30 June 2003, as amended and supplemented.
The personal data processed may include identification, contact, billing and shipping information, as well as information relating to orders placed and payments, within the limits necessary for managing the purchase and according to the methods provided by the payment service providers used.
The consumer may exercise, in the cases provided for by the applicable legislation, the rights of access, rectification, erasure, restriction of processing, data portability, objection to processing and withdrawal of consent, pursuant to Arts. 15-22 of the GDPR.
The data will be entered and kept in a digital archive on servers owned by Dalpasso Srl and processed by means of IT and telematic tools, adopting suitable technical and organisational measures to guarantee its security, confidentiality and integrity.
As regards this data, Dalpasso Srl informs you that it needs to collect and process the consumer’s data to complete product orders or to access particular services, to manage payments, invoicing, product delivery and customer assistance, and to fulfil tax, accounting, administrative and regulatory obligations provided for by law.
In this case, any refusal by the consumer would make it impossible to process the order or access the service.
Data processing is optional in every other case; the consumer’s data will be processed in written form and using electronic, telematic and paper means; processing will regard contractual requirements, including payment transactions, payment and address for the products ordered, in order to fulfil legal obligations or obligations imposed by the Authorities and, at the consumer’s explicit authorisation, also for commercial and promotional information purposes and for market research.
The consumer’s data may be communicated to employees of the company Dalpasso Srl, but will not be made known or communicated to third parties not employed by the same company, unless they are necessary or functional for carrying out contractual activities, i.e. Banks to handle payments, Carriers to transport products to the place indicated by the consumer, and other third parties that provide business activities and services required for the execution of the services that the consumer has requested and authorised Dalpasso Srl to provide.
Personal data will be kept for the time necessary to pursue the purposes for which it was collected and, subsequently, for the period provided for by applicable tax, accounting, administrative and legal obligations.
Marketing activities concerning the products and services of Dalpasso Srl
The processing of personal data also takes place, with the prior consent of the consumer where required by the applicable legislation, to send communications and advertising and/or promotional material, in order to propose new services, products and/or activities offered by Dalpasso Srl, as well as to carry out market research or opinion polls.

The consumer may withdraw at any time any consent given for marketing purposes, without affecting the lawfulness of processing based on consent before its withdrawal.
