Sales terms and conditions

The Sales Terms and Conditions given here regulate the offer and sale of products on the website www.dalpassoshop.it.

 

You must be over the age of eighteen to make a purchase. As regards anything not specifically provided for by the purchase terms and conditions below, any purchases made on Dalpasso Srl are regulated by Italian Legislative Decree No. 206, 6 September 2005 regarding consumer protection for remote on-line agreements.

The supplier of the products on the website is the company Dalpasso Srl, via Turri, 10, 42121. VAT 01432940359 – Reggio Emilia Business Register No. 01432940359, Economic and Administrative Index (REA) No. RE-185303, Chamber of Commerce (C.C.I.A.A.) Reggio Emilia.
Product specifications are provided in the on-line catalogue and can be viewed when you choose and complete the order form before sending it. The prices (inclusive of VAT and every other tax and duty) are given by the side of each product in the on-line catalogue.

The price invoiced will be the one next to the product on conclusion of the order, plus the delivery charge (where envisaged), without taking into account any subsequent updates.

Dalpasso Srl reserves the right to change product prices and delivery charges without prior warning.

Any new sums will take effect from the moment they are published on the Dalpasso Srl website and will be applied to sales made from then onwards.

Once the order has been completed, Dalpasso Srl will send an e-mail to confirm receipt of the order. The consumer is kindly asked to print the e-mail and keep it. In the event he/she does not receive it, he/she is kindly asked to notify Dalpasso.

If it is even temporarily impossible to partially or completely dispatch the order, Dalpasso Srl  will promptly send an e-mail to agree with the consumer, without prejudice to the possibility of the consumer asking to cancel the order, even partially and for the return of any corresponding sum already paid by credit card.

Should the user’s data prove to be incomplete or in any case inaccurate such as to make it impossible to deliver the parcel, Dalpasso Srl will contact the consumer to request confirmation of the shipping data or an alternative address in order to proceed with the shipment.

Payment

Dalpasso Srl offers a choice of various payment procedures when the order is finalised:

  • Credit Card (Visa, Mastercard, American Express and Diners Club)
  • PayPal (a PayPal account can be opened before completing the order on the PayPal login page)
  • Advance bank transfer to be made after completing the order, indicating the following data:
    • Beneficiary: Dalpasso Srl, Reggio Emilia;
      Bank: BPER Banca, Reggio Emilia
      IBAN: IT 16D0200812834000100225789;
      Reason for payment: order number and date; transferor’s name and surname;
    • Send your transaction number and a copy of payment/bank receipt to amministrazione@dalpasso.it  within 3 working days;

When we receive the bank credit, we will proceed to process your order. Your package will contain the accompanying invoice for your order with details of the products purchased and the relevant prices.

Any customs fees, duties and any other additional costs that may be requested by the customs or tax authorities are the sole responsibility of the buyer.

VAT relief

Some help is available for people with disabilities (listed in the Revenue Agency’s appropriate list), who are entitled to a 4% VAT relief at the time of purchase. In order to benefit, you must send amministrazione@dalpasso.it the mandatory documentation with proof of the percentage of disability.

If you are paying by bank transfer, your documentation must arrive before or at the same time as payment, so the reduction can be applied directly on your invoice. If you are paying by PayPal or Credit card, the documentation must be sent within 3 working days from your purchase: VAT will be reimbursed according to the difference by accrediting your PayPal account or the Credit card you used.

Delivery

Dalpasso Srl will deliver the products purchased via express courier, who guarantees delivery throughout the country in 24/48 hours from the day after dispatch.

Delivery will take place from Monday to Friday during normal working hours (9:00 am-1:00 pm; 2:00-5:30 pm). If the courier is unable to deliver as the addressee is absent, after two attempts it will leave a note of attempted delivery showing the details of whom to contact.
If delivery is delayed, the consumer is kindly asked to contact Dalpasso Srl and to report any inefficiencies noted.

Withdrawal

Art. 64, Italian Legislative Decree No. 206, 06/09/2005 on consumer protection for agreements made remotely on-line, envisages the possibility for the consumer to unconditionally exercise the right, i.e. without any costs and without having to provide an explanation, within 14 calendar days from the date of receipt of the goods indicated by the carrier. The consumer must return the products purchased, complete, undamaged and/or untampered with and with the original, undamaged packaging. Dalpasso Srl will reimburse the sum previously paid by the consumer.
The right of withdrawal can be exercised by sending an e-mail to marketing@otticadalpasso.it with the following data:

  • Invoice number and date
  • Order number
  • In the event of partial withdrawal, a description and quantity of the products you intend to return
  • Bank details to receive the reimbursement bank transfer (IBAN CODE).

If the name of the account holder differs from the name on the invoice, this must be clearly indicated. In the event of payment by credit card, the sum may be reaccredited directly on to the customer’s credit card used for payment.
The consumer must return the goods, which must arrive within 14  days at our registered office in Via Turri, 10 – 42121 Reggio Emilia. Return procedures are given in the section “Ordini e resi” on the website. In the event of withdrawal, the consumer will pay for all delivery costs, including any customs fees, of duty and any other ancillary expense should be required by the customs or tax authorities.

The refund of the amount already paid and corresponding to the entire order or that part of returned products (shipping costs excluded) will be made using the same payment method used by the buyer when the goods arrive at the shipping location and only if free of breakages, defects or tampering.

Guarantees

Should the consumer find a defect in one or more products purchased, he may exercise the right of withdrawal within 14 calendar days of receipt of the goods. Alternatively, the consumer can request a free replacement with an identical product, if available.
In this case Dalpasso Srl, having carried out the necessary checks, will proceed with the free replacement of the article.
If the purchased item is no longer available, Dalpasso Srl will be able to offer the purchaser an alternative product of similar value.

If any defect is discovered after the 14-day period, the consumer must promptly inform Dalpasso Srl by sending an e-mail to the amministrazione@dalpasso.it or by sending a PEC to the address otticadalpassosrl@legalmail.it

If the package contains a manufacturer’s guarantee certificate, this must be kept and shown together with the purchase invoice issued by Dalpasso Srl to request assistance under guarantee, to be carried out at the authorised laboratories, with delivery charges to be paid by the consumer. Dalpasso Srl is available to provide any information to this regard.

Personal data and privacy policy

Dalpasso Srl wishes to inform you that the data provided by the consumer will be processed pursuant to Law No. 196/2003. This data remains available for the consumer to check, amend or erase and to exercise any other right provided for by Arts. 7, 8, 9, Italian Legislative Decree No. 196, 30 June 2003. The data will be entered and kept in a digital archive on servers owned by Dalpasso Srl.
As regards this data, Dalpasso Srl informs you that it needs to collect and process your data to complete product orders or to access particular services (if the consumer refuses, it would be impossible to process the order or access the service), whereas it is optional in every other case. Your data will be processed in written form and using electronic, telematic and magnetic means and in hard copy. Processing will regard contractual requirements, including payment transactions, payment and address for the products ordered in order to fulfil legal obligations or obligations imposed by the Authorities and, at your explicit authorisation, also to send commercial and advertising information and for market research. Your data may be communicated to employees of the company Dalpasso Srl. However, it will not be made known or communicated to third parties not employed by same company, unless they are required to carry out the contractual activities, i.e. Banks to handle payments, Carriers to transport products to the place indicated by the consumer, other third parties that provide business activities and services required to the services requested and authorised by the consumer for Dalpasso Srl.

Marketing activities concerning the products and services of Dalpasso S.r.l.

The processing of personal data also takes place to send communications and advertising and/or promotional material, in order to propose new services, products and/or activities offered by Dalpasso S.r.l., as well as to carry out market research or opinion polls. The processing of data may take place by:

– e-mail;
– sms;
– phone contact;
– whatsapp.
